Two New Executive Orders Affecting Agency Guidance Documents

President Trump signed two executive orders on October 9, 2019 that aim to limit the impact and use of agency guidance documents. Guidance documents are used by federal agencies to clarify statutory and/or regulatory obligations.

Under these new orders, guidance documents are required to be located on easily searchable websites so that the individuals who need to access them are able to. One of the main goals of these orders is to help curb unchecked agency rulemaking to ensure a more transparent process for the use of guidance documents.
